Seeing from the judicial practice in Shanghai, when a company discharges this kind of laborers , not paying the subsidies on a plea of no labor ability appraisal, the people’s court will always reject it.

<span style="font-family: " microsoft="" yahei";="" line-height:="" 2;"="" line-height:2;"="">According to “Regulations of Shanghai Municipality on the Labor Contract “article 44, an employing unit, if dissolving a labor contract when the laborer suffers any disease or injury inflicted off the job, and is able to engage in neither the original work nor another work arranged by the employing unit otherwise, shall not only make economic compensation for the laborer concerned according to the relevant provisions, but also grant medical care subsidies to the laborer of not less than the laborer's six-month wage earnings. Thus it can be seen that labors are not forced to take the appraisal.
