Q:解除医疗期满的员工,是否需要支付医疗补助费?

       律师,你好。
       我公司一名无固定期限员工长期请病假,现在他的医疗期已经届满,公司决定和他解除劳动合同。在谈解除时,员工要求我们额外向他支付医疗补助费,对于他的这项主张,我们了解到员工应当事先做劳动能力鉴定,如他拒绝配合,公司不支付医疗补助费会有法律风险吗?

Our company wants to discharge an employee with open ended labor contract whose stipulated medical treatment period has completed, and he asked the company to pay him medical care subsidies in addition during the negotiation. We hear that the employee should take labor ability appraisal in advance. If possible, is there any risk we don’t pay him the subsidies when he refuse to take the appraisal?

律师答:

       从上海地区目前的司法实践来看,企业单方解除医疗期满的劳动者,以其未经劳动能力鉴定为由不支付医疗补助费的,法院不予支持。根据《上海市劳动合同条例》第四十四条,用人单位以劳动者患病医疗期满后不能从事原工作,也不能从事由用人单位另行安排的工作为由解除劳动合同的,除按规定支付经济补偿外,还应当给予不低于劳动者本人六个月工资收入的医疗补助费,未强制劳动者必须进行劳动能力鉴定。

According to “Regulations of Shanghai Municipality on the Labor Contract “article 44, an employing unit, if dissolving a labor contract when the laborer suffers any disease or injury inflicted off the job, and is able to engage in neither the original work nor another work arranged by the employing unit otherwise, shall not only make economic compensation for the laborer concerned according to the relevant provisions, but also grant medical care subsidies to the laborer of not less than the laborer's six-month wage earnings. Thus it can be seen that labors are not forced to take the appraisal.
