<p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">各省、自治区、直辖市及新疆生产建设兵团人力资源社会保障厅（局）、公安厅（局）：</span></p><p style=";margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">《</span><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">保障农民工工资支付条例</span><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">》</span><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">（以下简称《</span><span style="color:black"><span style="font-size:14px;font-family:'微软雅黑',sans-serif">条例</span></span><span style="font-size:14px;font-family: '微软雅黑',sans-serif;color:black">》</span><span style="color:black"><span style="font-size:14px;font-family:'微软雅黑',sans-serif">）第40</span><span style="font-size:14px;font-family:'微软雅黑',sans-serif">条</span></span><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">规定：“人力资源社会保障行政部门在查处拖欠农民工工资案件时，需要依法查询相关单位金融账户和相关当事人拥有房产、车辆等情况的，应当经设区的市级以上地方人民政府人力资源社会保障行政部门负责人批准，有关金融机构和登记部门应当予以配合。”为贯彻落实《</span><span style="color:black"><span style="font-size:14px;font-family:'微软雅黑',sans-serif">条例</span></span><span style="font-size:14px;font-family: '微软雅黑',sans-serif;color:black">》规定，及时查处拖欠农民工工资案件，维护农民工工资报酬权益，现就有关事项通知如下：</span></p><p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">一、人力资源社会保障行政部门劳动保障监察机构在查处拖欠农民工工资案件时，有权依法向公安机关交通管理部门查询相关当事人车辆登记情况并取得证明资料，公安机关交通管理部门应当予以配合。</span></p><p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">查询相关当事人车辆登记情况内容指当事人在公安机关交通管理部门办理的机动车相关登记情况。</span></p><p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">二、人力资源社会保障行政部门劳动保障监察机构开展查询工作时，应严格履行审批程序，由设区的市级以上人力资源社会保障行政部门负责人批准。</span></p><p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">三、人力资源社会保障行政部门劳动保障监察机构可向公安机关交通管理部门查询相关当事人在本地登记的机动车信息。需要查询相关当事人异地车辆登记情况的，可以直接向车辆登记地公安机关交通管理部门查询，也可以委托异地人力资源社会保障行政部门劳动保障监察机构开展相关查询工作。</span></p><p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">四、人力资源社会保障行政部门劳动保障监察员开展相关查询工作，不得少于2人，并应向公安机关交通管理部门出示劳动保障监察证件，出具《查询车辆登记情况通知书》。</span></p><p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">到直辖市公安机关交通管理部门查询的，《查询车辆登记情况通知书》由省级人力资源社会保障行政部门盖章；到设区的市或者相当于同级的公安机关交通管理部门查询的，《查询车辆登记情况通知书》由地市级人力资源社会保障行政部门盖章。</span></p><p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">五、公安机关交通管理部门在配合查询工作中，应如实提供相关信息，填写《查询车辆登记情况回函》，并在回函相应位置加盖单位公章；无法当天或现场查询完毕的，应当于收到《查询车辆登记情况通知书》之日起3个工作日内，反馈《查询车辆登记情况回函》。无被查询当事人车辆信息的，公安机关交通管理部门应当在《查询车辆登记情况回函》中注明并反馈。</span></p><p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">六、人力资源社会保障行政部门劳动保障监察机构及其工作人员对公安机关交通管理部门提供的信息负有保密义务。公安机关交通管理部门及其工作人员不得将查询工作情况和查询内容等告知被查询当事人或者第三方。</span></p><p style=";margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family: '微软雅黑',sans-serif;color:black">七、人力资源社会保障行政部门劳动保障监察机构、公安机关交通管理部门的工作人员未按《</span><span style="color:black"><a href="http://hr.wkinfo.com.cn/document/show?collection=legislation&aid=MTAwMTI3NDQ2MTc%3D&language=%E4%B8%AD%E6%96%87" target="_blank"><span style="font-size:14px;font-family:'微软雅黑',sans-serif">条例</span></a></span><span style="font-size:14px;font-family: '微软雅黑',sans-serif;color:black">》和本通知规定开展查询或配合查询工作的，按相关规定追究有关人员责任。</span></p><p style="margin-top:15px;margin-right:0;margin-bottom:0;margin-left:0;margin-bottom:0;text-indent:32px;line-height:30px;background:white"><span style="font-size:14px;font-family:'微软雅黑',sans-serif;color:black">各地人力资源社会保障行政部门劳动保障监察机构、公安机关交通管理部门要认真执行通知要求，加强沟通配合，结合实际进一步完善查询工作流程和机制，确保查询工作依法顺利开展。有条件的地区要积极通过信息化手段按照有关规定建立部门间查询共享机制。对查询工作中遇到的问题，请及时报告人力资源社会保障部劳动保障监察局、公安部交通管理局。</span></p><p><br/></p>
