style="font-size:18px;color:black">为保障劳动者权益,化解用工单位工伤风险,支持实体经济发展,促进社会和谐稳定,根据《工伤保险条例》《江苏省实施〈工伤保险条例〉办法》,结合我省实际,制定本办法。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: style="font-size:18px;color:black">第二条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">在本省行政区域内的国家机关、企业、事业单位、社会团体、民办非企业单位、基金会、律师事务所、会计师事务所等组织和有雇工的个体工商户(以下称用工单位)为本单位超过法定退休年龄人员在继续就业期间或者为本单位实习生在实习期间参加工伤保险的,适用本办法。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第三条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">本办法所指超过法定退休年龄人员(以下简称超龄就业人员),是指用工单位招用的已经达到或者超过法定退休年龄但年龄不超过</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">65</span><span style="font-size:18px;color:black">周岁、未办理退休手续的就业人员。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">本办法所指实习生,是指年满</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">16</span><span style="font-size:18px;color:black">周岁,由实施全日制学历教育的技工院校、中高等职业学校根据法律、法规和国家有关规定集中统一安排学期性顶岗实习的学生。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第四条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">用工单位应当对超龄就业人员、实习生进行安全生产和职业病防治教育,执行安全卫生规程和标准,预防工伤事故发生,避免和减少职业伤害。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">用工单位应当按照国务院卫生行政部门的规定,对从事接触职业病危害作业的超龄就业人员、实习生组织上岗前、在岗期间和离岗时的职业健康检查,并将检查结果书面告知超龄就业人员、实习生。职业健康检查费用由用工单位承担。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第五条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">用工单位可以依据本办法为超龄就业人员、实习生参加工伤保险。用工单位为超龄就业人员、实习生参加工伤保险的,应当持与超龄就业人员签订的用工协议或者三方实习协议、参保花名册及《江苏省超过法定退休年龄人员和实习生参加工伤保险承诺书》至用工单位参保地的社会保险经办机构办理参保登记手续。入职体检(职业病筛查)情况、在校学生就读证明、未办理退休手续证明等证明事项采用告知承诺制。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第六条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">用工单位自愿依据本办法为超龄就业人员、实习生参加工伤保险的,应当按规定为超龄就业人员、实习生申报缴纳工伤保险费。用工协议或者三方实习协议期满后,社会保险经办机构应当为参加工伤保险的超龄就业人员、实习生办理停止缴费手续。需要提前解除、终止或者续签协议的,用工单位应当及时向社会保险经办机构办理相关手续。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">用工单位未按本办法为超龄就业人员、实习生参加工伤保险或者未及时办理续签协议手续延长工伤保险参保关系的,社会保险经办机构不受理其补申报和补缴申请。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第七条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">超龄就业人员、实习生的工伤保险费实行人社核定、税务征收,缴费费率按所在用工单位的费率标准执行,缴费基数由社会保险经办机构核定后传递至税务部门。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">超龄就业人员的工伤保险费征收以自然月为结算期,工伤保险费数额为用工单位超龄就业人员实际劳动报酬总额乘以单位缴费费率之积。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">实习生的工伤保险费征收以实习协议期为结算期,自办理参保登记手续后一次性申报征收,工伤保险费数额为用工单位实习生实习协议期间实际劳动报酬总额乘以单位缴费费率之积。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">超龄就业人员、实习生劳动报酬高于全省社会保险缴费工资基数上限的,按照全省社会保险缴费工资基数上限确定缴费基数;劳动报酬低于全省社会保险缴费工资基数下限的,按照全省社会保险缴费工资基数下限确定缴费基数。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第八条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">超龄就业人员、实习生在参保期间发生工伤或者患职业病的,其工伤认定、劳动能力鉴定、工伤保险待遇参照《工伤保险条例》《江苏省实施〈工伤保险条例〉办法》有关规定执行。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第九条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">超龄就业人员、实习生在参保期间发生工伤或者患职业病,因工致残被鉴定为一级至十级伤残的,由工伤保险基金按规定支付一次性伤残补助金。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第十条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">以用工单位职工身份延长养老保险缴费期间的超龄就业人员因工致残被鉴定为一级至四级伤残的,在其办理退休手续前,由用工单位和职工本人以伤残津贴为基数,缴纳基本养老保险费、基本医疗保险费。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">依据本办法参加工伤保险的超龄就业人员、实习生因工致残被鉴定为一级至四级伤残的,在办理退休手续后,停发伤残津贴,按照国家有关规定享受基本养老保险待遇。基本养老保险待遇低于伤残津贴的,由工伤保险基金补足差额。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第十一条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">超龄就业人员在参保期间发生工伤或者患职业病,因工致残被鉴定为五级至十级伤残,与用工单位解除或者终止用工关系的,不支付一次性工伤医疗补助金和一次性伤残就业补助金,其治疗工伤所需医疗费、到签订服务协议的医疗机构进行工伤康复的费用、经劳动能力鉴定委员会确认的辅助器具配置费用由工伤保险基金按规定支付。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">实习生在参保期间发生工伤或者患职业病,因工致残被鉴定为五级至十级伤残,与用工单位解除或者终止实习关系的,由工伤保险基金和用工单位按规定分别支付一次性工伤医疗补助金和一次性伤残就业补助金。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第十二条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">超龄就业人员、实习生在参保期间发生工伤或者患职业病,因工致残被鉴定为五级至十级伤残或者经鉴定为不达级,与用工单位解除或者终止用工、实习关系的,劳动能力鉴定委员会不再受理其本次伤残的劳动能力复查鉴定申请。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第十三条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">用工单位按本办法为超龄就业人员参加工伤保险后欠费期间,超龄就业人员发生工伤的,该超龄就业人员的各项工伤保险待遇,均由用工单位按规定支付。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">用工单位按规定足额缴纳欠费期间的工伤保险费后,上述超龄就业人员新发生的工伤保险待遇按照《江苏省人力资源和社会保障厅关于实施〈工伤保险条例〉若干问题的处理意见》(苏人社规〔</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">2016</span><span style="font-size:18px;color:black">〕</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">3</span><span style="font-size:18px;color:black">号)执行。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第十四条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">用工单位为本单位超龄就业人员、实习生参加工伤保险,双方发生工伤待遇方面争议的,参照处理劳动争议的有关规定处理。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">第十五条</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">&nbsp;&nbsp;</span><span style="font-size:18px;color:black">按本办法参加工伤保险的超龄就业人员,在办理退休手续后,用工单位应当及时至社会保险经办机构为其办理工伤保险停保手续。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">用工单位按本办法为实习生参加工伤保险的,可以与相关学校在实习协议中约定工伤保险责任分担办法。未按本办法参加工伤保险的实习生提起工伤认定申请的,工伤保险行政部门不予受理。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans: 2;text-align: start;widows: 2;-webkit-text-stroke-width: 0px;word-spacing:0px"><span style="font-size:18px;color:black">依据本办法参加工伤保险的实习生,在同一学历或者技能等级教育阶段参加工伤保险的时长一般不得超过</span><span style="font-size:18px;font-family:&#39;Helvetica&#39;,sans-serif;color:black">12</span><span style="font-size:18px;color:black">个月。</span></p><p style="text-indent:32px;line-height:32px;margin:0.1rem;box-sizing: border-box;font-variant-ligatures: normal;font-variant-caps: normal;orphans:
